Division of Powers - Topics

Constitutional Law II considers the division of powers between parliament and provincial legislatures. In particular, Constitutional Law II concentrates on:

·         property and civil rights in the province,

·         trade and commerce powers,

·         residuary and emergency powers,

·         taxation and spending powers,

·         the criminal law

·         and Aboriginal peoples.

Constitutional Law II also exposes students to the basic doctrines that assist to operate the federal system. In particular students are exposed to:

·          federalism and flexibility,

·         Quebec’s continuing grievances,

·         supremacy of the constitution,

·         the rule of law,

·         separation of powers,

·         classification of laws for the purposes of assigning constitutional jurisdiction to parliament or the legislatures,

·         paramountcy

·         and interjurisdictional immunity.
